CURRENT DRUG LAWS EXPLAINED

As you may have heard, the people of Oklahoma voted to change the drug laws in the State of Oklahoma. However, it only applies to simple possession occurring after the drug law changed.

SIMPLE POSSESSION= 1 year jail

WITH INTENT= Prison time

TRAFFICKING= Prison time

To understand completely you must first understand what simple possession is. In general, if you have knowledge and control over a small amount of controlled drugs, you are in possession of a misdemeanor amount. The issue has more to do with control and personal use.

This applies to all drugs that were felonies before. This means even heroin and meth are misdemeanors that carries 1 year in jail regardless of any prior convictions you may have. It is important to remember that a prosecutor does not have to reduce felonies to misdemeanors if the crime was committed before the law change.

POSSESSION WITH INTENT AND TRAFFICKING ARE STILL FELONIES

There is too much to explain here about the ranges of punishment. But, any drug possession in which there is an intent to distribute element is still a felony. Also, any amount above a certain weight is trafficking and are all felonies.
